The Senate takes a 60-vote cloture test on the CLARITY Act on September 15. That puts a dated binary on the calendar four sessions out.

Treasury Secretary Scott Bessent urged passage, framing the bill as a national security tool. Coinbase CEO Brian Armstrong said clarity arrives either way, with the SEC and CFTC ready to act.

Morgan Stanley initiated Coinbase at Hold, citing earnings that still swing with the crypto cycle. Shares fell on the note.

Verdict

The desk reads this as a market-structure event, and market structure means payment rails. Visa at $366.86 is the level we are watching into Tuesday.

Four of ten names on our board closed green. The megacap complex is not paying up for legislative risk.

The Names

V — $366.86, -0.14%. The obvious crypto expression is Coinbase, and Morgan Stanley just explained why that is priced. The less obvious exposure is payments.

Visa is down 3.1% over five sessions. It sits 4.5% under the 90-day high of $384.06. A settlement-rules bill is a Visa question too. Below the widely watched $360.00 round number, the bleed extends. Above $370.00, it is over.

NVDA — $218.01, -2.53%. Biggest loser on the board. Third consecutive red close, gapped down 1.4%, finished in the lower third of the range.

We called sub-$225 last week and got it. The next line is $215.00 — below it, the slide runs at the 90-day floor.

AAPL — $322.09, +2.14%. We called Apple below $310 on Tuesday. Wrong. It gapped up 0.45%, closed in the upper fifth of its range, and printed the second-heaviest volume on the board.

Apple outperformed NVIDIA by 4.67 percentage points in a single session — the widest megacap spread of the day.

That downside call is finished above $325.00.

AMD — $508.00, -2.51%. Gapped down 2.3% and never recovered. Still up 11.3% over five sessions. Still 3.2% below the 90-day high of $525.00. Our $525 call is live but short on time.

The Risk Sheet

  • Cloture passes clean and the overhang lifts → Visa above $370.00 → the payments discount was wrong and we drop the read.
  • Hot core inflation keeps rate-hike chatter alive → JPMorgan below $351.12 → a fourth red close becomes a fifth.
  • Semis keep bleeding into the event → NVDA below $215.00 → the AI complex stops absorbing broad-market risk.
  • Apple keeps squeezing → AAPL above $325.00 → leadership rotates fully out of semis.

What flips the desk: a cloture pass with the vertical-integration dispute settled. Remove the event risk and the payments discount goes with it.
